Marian’s Grass Cutting Services

These Terms of Service (“Terms”) govern your use of services provided by Marian’s Grass Cutting Services (“we,” “us,” or “our”), a sole proprietorship based in Pennsylvania, including our lawn care and field services, our website at mariansgrasscutting.com, and our text messaging program.
By requesting an estimate, scheduling service, accepting service, paying an invoice, visiting our website, or sending or receiving text messages from us, you agree to these Terms. If you do not agree to these Terms, please do not use our services.
We provide residential and commercial lawn care and related field services, which may include lawn mowing, trimming, edging, leaf removal, seasonal cleanups, and similar outdoor property maintenance. The specific services we provide to you will be described in your estimate, work order, or invoice.
Estimates and quotes are based on the property information and service scope provided to us at the time of the quote. If conditions on site differ materially from what was described or observed during the estimate—for example, overgrown grass, debris, hazards, or a larger service area than expected—we may adjust the price before performing the work. We will let you know before any change to the agreed price.
Unless otherwise stated, estimates are valid for 30 days from the date issued.
We schedule services in advance and assign each customer a recurring or one-time visit window. Exact arrival times within a scheduled day may vary based on routing, weather, and prior jobs. We will make a reasonable effort to send you a notification or text message before arrival when possible.
Lawn care is a weather-dependent service. We reserve the right to reschedule visits due to rain, lightning, extreme heat, frozen or saturated turf, or any other condition that we determine, in our sole discretion, could damage your property or equipment, or create an unsafe working environment. Rescheduled visits will typically be moved to the next available service day.
If a recurring visit is skipped or postponed because of weather, we will resume the regular schedule on the next available service day. Skipped visits do not generally entitle the customer to a credit unless we specifically agree otherwise in writing.

We are not responsible for damage to undisclosed or hidden items, including but not limited to sprinkler heads, landscape lighting, invisible-fence wires, decorative items, or fragile features that were not marked, flagged, or otherwise disclosed before service.
Invoices are sent through our customer management platform (Jobber). Unless we agree otherwise in writing, payment is due upon receipt of the invoice. We accept the payment methods listed on the invoice.
All amounts are stated in U.S. dollars. You are responsible for any applicable sales or service taxes.
Invoices not paid within 30 days of the invoice date may be considered past due. We reserve the right to pause or cancel future scheduled services for any account with a past-due balance, and to recover reasonable collection costs permitted by Pennsylvania law for accounts that remain unpaid.
You may cancel a scheduled visit or recurring service at any time by contacting us using the information in Section 14. We ask for at least 24 hours’ notice before a scheduled visit when possible so we can adjust our routing. Visits already completed remain billable.
We reserve the right to discontinue service to any customer at our discretion, including for non-payment, unsafe site conditions, or abusive conduct toward our personnel.
These SMS Program Terms apply to all text messages sent to or from Marian’s Grass Cutting Services. By providing your mobile phone number to us, you agree to these SMS Program Terms.
Marian’s Grass Cutting Services SMS Program.
Our SMS program is used to communicate with current and prospective customers about our lawn care and field services. Message types include appointment confirmations and reminders, on-the-way notifications, schedule changes, weather-related rescheduling, quotes, invoices, payment confirmations, replies to your questions, and occasional service or seasonal updates relevant to your account.
Text messages will be sent and received through our dedicated business number, (570) 994-3534.
Message frequency varies based on your service schedule and your communications with us. Most customers receive only a few messages per service visit.
Message and data rates may apply, depending on your wireless carrier and plan. Marian’s Grass Cutting Services does not charge a fee to send or receive text messages.
You can opt out of our SMS program at any time by replying STOP to any text message you receive from us. After you reply STOP, you will receive one final confirmation message and we will not send you further automated text messages. You can also ask us to remove your number by calling or emailing us using the information in Section 14.

Wireless carriers, including but not limited to AT&T, T-Mobile, Verizon, and their affiliates, are not liable for delayed or undelivered messages.
Our SMS program is intended for customers and prospective customers age 18 or older located in the United States. By participating, you confirm you are the account holder of the mobile number you provided, or that you have the account holder’s permission to receive messages at that number.
Information collected through our SMS program is handled in accordance with our Privacy Policy, available at mariansgrasscutting.com/privacy-policy. No mobile information, including phone numbers and SMS opt-in data, will be shared with third parties or affiliates for marketing or promotional purposes.
All content on mariansgrasscutting.com, including text, logos, photographs, and graphics, is the property of Marian’s Grass Cutting Services or its licensors and is protected by applicable intellectual property laws. You may view and share our website for personal, non-commercial purposes, but you may not copy, reproduce, or use our content for commercial purposes without our written permission.
We perform our services with reasonable skill and care. However, our services and our website are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly required by Pennsylvania law.
We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, Marian’s Grass Cutting Services and its owner, employees, and subcontractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of business, arising out of or related to our services, our website, or these Terms.
Our total liability to you for any claim arising out of or related to our services or these Terms will not exceed the total amount you paid us for the specific service giving rise to the claim during the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited under Pennsylvania law.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or our services that cannot be resolved informally will be brought exclusively in the state or federal courts located in or serving Monroe County, Pennsylvania, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time to reflect changes in our services, our practices, or applicable law. When we make changes, we will update the “Effective Date” at the top of this page and post the updated Terms on our website. Your continued use of our services or our website after the updated Terms are posted constitutes your acceptance of the updated Terms.
Our collection and use of personal information is described in our Privacy Policy, available at mariansgrasscutting.com/privacy-policy. The Privacy Policy is incorporated into and made part of these Terms by reference.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of that provision. These Terms, together with the Privacy Policy and any written estimate or work order, constitute the entire agreement between you and Marian’s Grass Cutting Services regarding your use of our services and our website.
